PROSECUTION OF A GBGB LICENSED GREYHOUND TRAINER
07/09/22 UPDATE
The case has came to an end without the evidence going to trial.
Reason;
The prosecutions most important witness confirmed withdrawal on the 18th August 2022 and failed to turn up at the court on the 1st day of the 5 days booked for the trial, preventing us from proceeding with the case.
We initially had 2 witnesses, and an expert witness'
Whilst our expert witness remained available the 2 non expert witnesses went cold on us at the same time and very shortly before the trial.
We must state that both these witnesses were fully cooperative and supportive throughout the 3.5yrs it took for us to get to trial following a large number of hearings and several cancelled trials; they only withdrew after it was confirmed by the judge that there would be no more delay before fixing the trial date.
We could have proceeded without the main witness had she have given us reason for her withdrawal but we were met with a dead silence.
It was our responsibility to make all efforts to bring the witness to the court however the judge refused to sign the witness summon in the name of justice, as the case had gone on for 3.5yrs and could not be further delayed.
In the eyes of justice, a prosecutor cannot be held responsible for the actions of the witness or the judge refusing to summon the witness.
Therefore Caged 'The prosecutor' was not found to be responsible for the fees that the GBGB or the defendants paid.
We cannot speculate as to why our key witness very suddenly went cold and we ask that you keep your thoughts on this to yourselves.
We are happy to produce copies of the receipts for the court costs to those who donated specifically for the court case providing we are sent a PayPal reference number or other evidence; email [email protected]
We would like to thank Kendal Shepherd BVSc, CCAB, MRCVS, the independent veterinary expert, for all of her work on our case.
We would also like to thank our two excellent Barristers, Adam and Julia, and assistant Hannah from Goldsmiths Chambers in London, and our Solicitor Gary who carried out all of our litigation.
Thank you to everyone who donated.
